Decision

It was proposed that a person moving stock across roads must be a competent person, aged 16 years or older.

The 16-year-old age requirement has been removed. All persons moving stock are still required to be competent, and a definition of ‘competent person’ is now included in the bylaw.

The proposed bylaw required ‘excessive’ stock excrement to be removed from roads, after stock are moved across or down roads.

This rule remains; however, a definition of ‘excessive’ stock excrement has now been included within the bylaw. ‘Excessive’ is as judged more than reasonable by a Council authorised officer.

It was proposed that there was a maximum droving distance of 400 metres to move livestock along public roads.

The 400 metre limit was removed, and there is now no maximum droving distance. All other safety requirements in the bylaw must be adhered to, as proposed.

It was proposed Livestock Crossings require signs, which would be installed by Council.

Farmers can now purchase their own signs for stock crossings, if these align with Council standards, but installations and locations are to be signed off by Council.

The bylaw outlined the process for evaluating new permit applications or renewing existing permits (Appendix 3), according of the type of road and how frequently stock are being moved.

A note was included to clarify a roads allocated road hierarchy could change if the speed limit or volume of road traffic increases or decreases.

The table heading was amended so that it was clear permit applications were evaluated against the weekly number of stock crossings or movement, averaged throughout the entire year.
